Liquidator’s Claim Against a Director

25 January 2025

Task

Our client approached us after receiving a letter of claim from the liquidator of their insolvent company. The claim alleged unlawful distributions made by the client, and his co-director.

Action

Our client faced serious allegations, but was able to provide us with the background and documentary evidence which supported his position. We prepared a response, pointing out that our client had a non-executive role and was not involved in the financial management of the company, therefore could not be held liable.

Result

We successfully reduced the claim by 85%. This outcome provided our client with much-needed relief and the opportunity to move forward from this challenging situation.
